SOKOLOFF STERN HEADING TO UNITED STATES SUPREME COURT

April 17, 2017

The U.S. Supreme Court is set to hear argument in Town of Chester v. Laroe Estates, Inc. on April 17, 2017. The important procedural issue before the Court is: “Whether intervenors participating in a lawsuit as of right under Federal Rule of Civil Procedure 24(a) must have Article III standing (as three circuits have held), or whether Article III is satisfied so long as there is a valid case or controversy between the named parties (as seven circuits have held).” Partners Brian Sokoloff and Steven Stern will be attending the argument with Neal Katyal of Hogan Lovells, who will present the Town’s arguments. Town’s Merits Brief may be found here.
